1.1Senator Abeler moved to amend the (SCH0001A51) amendment to H.F. No. 1 as

1.5    "Sec. 2. [145.4125] INFORMATION TO MINORS.
1.6    Subdivision 1. Information. (a) Notwithstanding any law to the contrary, no health care
1.7practitioner shall perform an abortion or a sterilization procedure upon a patient who is a
1.8minor without first informing the patient that she may experience emotional repercussions
1.9following the procedure, including depression, guilt, and distress. The practitioner or a
1.10person acting on behalf of the practitioner must provide the patient with information on
1.11where the patient may receive counseling if desired, including public and private agencies
1.12that may provide counseling services on a sliding fee scale or at no cost.
1.13(b) The practitioner must make a notation in the patient's medical record that the
1.14information described in paragraph (a) was provided to the patient.
1.15    Subd. 2. Civil damages. A civil action for compensatory and punitive damages may be
1.16brought by the patient or the patient's parent or guardian against the health care practitoner
1.17who performed the procedure if the information described in subdivision 1 was not provided
1.18and the patient suffered emotional or psychological harm directly related to the abortion or
1.19sterilization procedure.
1.20    Subd. 3. Exception. (a) This section does not apply if the abortion or sterilization
1.21procedure was performed because of a medical emergency and there was not time to provide
1.22the information before performing the procedure.
1.23(b) For purposes of this subdivision, "medical emergency" means a condition that, in
1.24reasonable medical judgment, so complicates the medical condition of the patient as to
1.25necessitate an immediate abortion to avert the patient's death or for which a delay will create
1.26serious risk of substantial and irreversible physical impairment of a major bodily function.
1.27EFFECTIVE DATE.This section is effective August 1, 2023, and applies to causes
1.28of action occurring on or after that date."
