1.1Senator Benson moved to amend S.F. No. 106 as follows:
1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. SUPPLEMENTAL PAYMENTS TO MEDICAL ASSISTANCE DENTAL
1.4PROVIDERS FOR PERSONAL PROTECTIVE EQUIPMENT DURING THE
1.5COVID-19 PANDEMIC; APPROPRIATION.
1.6    Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.7the meanings given.
1.8(b) "Commissioner" means the commissioner of human services.
1.9(c)" Eligible provider" means a dentist or dental clinic that:
1.10(1) accepts patients who are covered by medical assistance;
1.11(2) is actively enrolled as a medical assistance provider on August 15, 2020;
1.12(3) is located in Minnesota;
1.13(4) is not paid on a cost-based payment system; and
1.14(5) has received at least $5,000 in medical assistance payments from claims with a date
1.15of service on or after October 1, 2019 through April 1,2020.
1.16(d) "Medical assistance payments" means payments received for providing dental services
1.17to medical assistance enrollees from claims submitted to either the commissioner or to a
1.18managed care plan or county based purchasing plan, or to the plan's subcontractor.
1.19    Subd. 2. Supplemental payments. (a) By August 15, 2020, the commissioner shall pay
1.20a onetime supplemental payment to each eligible provider for the purpose of assisting in
1.21the increased costs incurred by the provider for personal protective equipment during the
1.22COVID-19 pandemic.
1.23(b) The supplemental payment to each eligible provider shall be based on a distribution
1.24formula established by the commissioner within the amount of the appropriation and the
1.25requirements of this section. For each claim paid with a date of service on or after October
1.261, 2019 through April 1, 2020, the eligible provider shall receive a fixed dollar amount not
1.27to exceed $10 per claim. Only claims received by the commissioner before July 1, 2020,
1.28shall be considered for the supplemental payment.
1.29(c) Notwithstanding paragraph (a), if a dentist or dental clinic meets the criteria in
1.30subdivision 1, paragraph (c), clauses (1) through (4), but enrolled as a medical assistance
2.1provider after October 1, 2019, the commissioner may calculate a pro-rated supplemental
2.2payment for the dentist or dental clinic.
2.3    Subd. 3. Appropriation. $5,000,000 is appropriated in fiscal year 2021 from the
2.4coronavirus relief federal fund to the commissioner of human services for the supplemental
2.5payments authorized in this section. The total amount of supplemental payments paid under
2.6this section must not exceed the amount appropriated. If based on the fixed dollar amount
2.7of the supplemental payment per claim specified in subdivision 2, there are unobligated and
2.8unexpended funds from the appropriation, these funds shall be returned to the coronavirus
2.9relief fund by September 1, 2020.
2.10EFFECTIVE DATE.This section is effective the day following final enactment."
