Section 1 [Temporary Conditions] provides that until wetland banking credits are established in all wetland bank service areas for replacing wetlands due to local road projects on existing roads, the following temporary conditions will apply:

(1) the Board of Water and Soil Resources must transfer existing credits from one wetland bank service area to another wetland bank service area that needs the credits to the extent permitted under state and federal law; and

(2) local road projects for existing local roads will be exempt from replacement of wetlands to the extent they are exempt under a U.S. Army Corps of Engineers general permit.

Section 2 [Appropriation] appropriates $5 million in fiscal year 2017 from the general fund to the Board of Water and Soil Resources for the acquisition of wetland banking credits that will be used for wetland replacement due to local road projects on existing roads.
