Section 1, subdivision 1, authorizes a person who has been providing mixed municipal solid waste services within a political subdivision to bring a district court action to compel the political subdivision to commence condemnation proceedings if the political subdivision determines to provide municipal solid waste services previously provided by private persons within the jurisdiction, or limits the number of private persons who are permitted to do so, in a manner that would exclude the person from continuing to provide those services.

Subdivision 2 provides that an action may not be maintained against a political subdivision if the person provides mixed municipal solid waste services under a contract with the political subdivision that sets forth the terms and conditions under which the person, or a corporation or an association in which the person is a shareholder or member, can provide the services.

Subdivision 3 contains a six-month statute of limitations for bringing an action under subdivision 1.
