Section 1 [Initiation; Decision; Agreement to Arbitrate] requires an agency to submit contested cases to the Office Of Administrative Hearings and makes final the decision of an administrative law judge (“ALJ”).  Under current law, an agency decides contested cases; the agency may order that the report of an ALJ be the final decision in the case. There are, currently, some exceptions to the agency’s authority to decide cases, such as human rights hearings, where an ALJ report is the final decision in a contested case.
