The 2011 Omnibus Capital Investment Bill appropriates $478,278,000 from general fund debt service; $33,862,000 from user-financed debt service; $43,000,000 from the state transportation fund; and reflects $23,700,000 in cancellations or reductions of prior bond authorizations.

 

Section 1 [Capital Improvement Appropriations] summarizes the appropriations, generally by agency, and totals the appropriations and bond sale expenses.

 

Sections 2 through 20 appropriate funds to specified entities, projects, and programs.  These are summarized in the table below and are further detailed in a related spreadsheet.

Section 21 [Bond Sale Expenses] appropriates $533,000 to the Commissioner of Management and Budget to pay expenses associated with a bond sale.

 

Section 22 [Bond Sale Schedule] limits the amount of bonds to be issued during the biennium, including the bonds authorized in this bill, so that no more than a certain amount will be needed from the general fund for debt service, thus keeping the state within its budgeted amount for debt service.

 

Section 23 [Bond Sale Authorization] authorizes the sale of bonds to fund the various appropriations in the bill from the bond proceeds fund (Subdivision 1) and the transportation fund (Subdivision 2).

 

Section 24 [2008, 2010 Authorization Reduced] reduces the bond authorization from prior years, reflecting vetoed, cancelled, or reduced appropriations.

 

Section 25 [Negotiated Sales; Temporary Authority] extends for two years the authority for Minnesota Management and Budget (MMB) to sell bonds via negotiated sales.  (Until two years ago, MMB was required by statute to award all bond issues by competitive bids.  Two years ago, we granted them authority, for two years, to use negotiated sales.)

 

Section 26 [Credits of Proceeds] amends the bonding statute to allow greater flexibility in the use of premiums from bond sales.  Under current law, premiums are credited to the state bond fund and are used to defray the cost of repaying bonds in the first year of debt payments.  This amendment gives the commissioner an additional option to credit the bond proceeds fund and reduce the total amount of bonds sold.

 

Section 27 [Cancellation] provides that when a premium is credited to the bond proceeds fund, the corresponding bond authorization to which the premium is attributable must be reduced.  This section works in concert with section 26 [Credits of Proceeds].

 

Section 28 [Flood Hazard Mitigation Grants] extends until December 31, 2014, the deadline for the authorization of bonds for certain flood mitigation grants, originally authorized in 2006.

 

Section 29 [Northeast Minnesota Rail Initiative] extends until June 30, 2012, the deadline for the authorization of bonds for renovation to the St. Louis County Heritage and Arts Center (the Duluth Depot), originally authorized in 2006.

 

Section 30 [Metropolitan Regional Parks Capital Improvements] amends the project description for the Cedar Avenue Bridge project, for which bonds were authorized in 2006.  This is one of three sections that amend prior appropriations for the Cedar Avenue Bridge project.  The others are in sections 36 and 45.  These sections amend the purpose of the appropriation to fund environmental analysis and review, design, and construction of a multimodal trail connection and development of a segment of the Minnesota Valley State Trail.

 

Section 31 [Southeastern Minnesota Regional Public Safety Training Center] reduces by $700,000 the appropriation for the Southeastern Minnesota Regional Public Safety Training Center in Olmsted County.  Allows the county’s expenditures for this project made on or after December 27, 2007, before the bond authorization of 2008, to count towards their match requirement. 

 

Section 32 [Systemwide Campus Redevelopment, Reuse, or Demolition] reduces the appropriation for and changes the identification of entities for the Ah Gwah Ching Regional Treatment Center project.

 

Section 33 [Hennepin County Medical Center] modifies the description of the project to eliminate an outpatient clinic and eliminates the requirement that the project include teaching clinics and an education center.

 

Section 34 [Heating, Ventilating, Air Conditioning Replacement] operates in conjunction with section 46. These sections shift appropriations between portions of this project and revise the descriptions of the project at the Minneapolis Veterans Home Campus.

 

Section 35 [County and Local Preservation] exempts the city of Hokah from the requirement for a match from nonstate sources for renovation projects at the Hokah City Hall and Houston County Historical Society.

 

Section 36 [Old Cedar Avenue Bridge] is the second of three sections amending prior appropriations for the Cedar Avenue Bridge project.  See also sections 30 and 45.  These sections amend the purpose of the appropriation to fund environmental analysis and review, design, and construction of a multimodal trail connection and development of a segment of the Minnesota Valley State Trail.

 

Section 37 [Veterans Cemeteries] amends the locations for land acquisition for new veterans cemeteries and revises the way in which federal reimbursement is managed.

 

Section 38 [Effective Date] amends the expiration date to July 1, 2013, for the law authorizing negotiated sales for bond issues.  See also section 25.

 

Section 39[Alpha Building Demolition] and section 40 [Storage and Maintenance Building] amend appropriations for the Perpich Center for the Arts.  This shifts money from the demolition portion of the project to construction and expands the purposes for the new building to include maintenance.

 

Section 41 [Trail Connections] exempts the Rocori Trail Board from the requirement for a match from nonstate sources for the Rocori Trail project.

 

Section 42 [St. Mathias Trail Paving – Fort Ripley] changes the entity receiving the grant for a trail in St. Mathias Park from the city of Fort Ripley to the township of St. Mathias.

 

Section 43 [Fort Snelling Upper Bluff] adds authorization for Hennepin County to use this appropriation to rehabilitate buildings and sites at Fort Snelling Upper Bluff for occupancy.

 

Section 44 [State Emergency Operations Center] revises an appropriation for a State Emergency Operations Center in Arden Hills to allow the acquisition of land and easements.

 

Section 45 [Metropolitan Regional Parks and Trails Capital Improvements] is the third section amending prior appropriations for the Old Cedar Avenue Bridge.  See also sections 30 and 36.  These sections amend the purpose of the appropriation to fund environmental analysis and review, design, and construction of a multimodal trail connection and development of a segment of the Minnesota Valley State Trail.

 

Section 46 [Minneapolis Veterans Home] works in concert with section 34, as described above.

 

Section 47 [Planning New Veterans Cemeteries] adds a provision to give priority to the county of Fillmore for the veterans cemetery to be located in southeastern Minnesota.

 

 Section 48 [Dam Renovation and Removal] adds “streambed restoration” to the project description for removal of a dam in the DR-1941 area.

 

Section 49 [Acquisition of Easement; Minnesota Correctional Facility in Faribault] authorizes the Commissioner of Administration to acquire an easement for utility and access purposes for the Minnesota Correctional Facility in Faribault.

 

Section 50 [Effective Date] sets the effective date for this act as the day following enactment.
