Section 1 defines “law enforcement assistant” for the purposes of the bill.

 

Section 2 establishes a gross misdemeanor penalty for assaulting a law enforcement assistant while the assistant is performing official duties.  

 

Section 3 adds law enforcement assistants and their horses to the statute that creates criminal penalties for assaulting police horses.  The new language would punish those who assault an assistant’s horse at the same level as would apply to an assault on a police horse.  The penalties range from a gross misdemeanor to a five-year felony based on the level of harm caused to the horse and whether the peace officer, law enforcement assistant, or another person is injured in the assault.

 

The bill is effective August 1, 2011, and applies to crimes committed on or after that date.
