Section 1, subdivision 4 [Prevailing hours of labor] modifies the definition of “prevailing hours of labor” to mean a maximum of 40 hours per week for purposes of overtime pay.  Currently, the prevailing hours of labor contain a daily maximum of eight hours per day in addition to the 40 hour per week limit.

Section 1, subdivision 6 [Prevailing wage rate] modifies the definition and calculation method for prevailing wage rates to be calculated by finding the mean hourly compensation paid to workers in the same class of labor within the area where a project is located.  The prevailing wage rate is currently calculated by using the most commonly reported rate (the “mode”) for a particular job class in a geographic area.
